• ORDINATION : The order implies the acceptance of the following sale terms to which, if not formerly agreed in written, any kind of derogation is not admitted. All orders coming through agents and representatives will be accepted only after company’s approval. In order to avoid any kind of mistake, it will always be better to specify the item code.

• PRICES : The prices always refer to material sold on EX-Works basis, except when formerly agreed in written. The prices of “TITANOX srl” products are exposed inside the price lists in force and inside the offers. The prices could be varied in every moment and they will become valid at the same date of their change.

• ORDERS : Orders under a total amount of € 500,00 will not be processed. The payment must always be made at the order confirmation, if not differently agreed in written.

• PAYMENT : If the Customer, for any reason, will not collect the ordered goods, the paid amount will be appropriate as indemnification. Every single shipment will be considered as independent from all the others for payment purposes. Every kind of contestation will arise between the parties, even about the warranties, will not give the opportunity to change the payment terms, to delay or suspend the payments. Every action carried out by the Customer will not be considered as acceptable, if the Customer will not demonstrate to be in order with the payments. On overdue and unpaid amounts, being understood the company’s right to request the payment, a 15% interests will be applied.

• PACKING : Standard packing included in the price.

• SHIPMENT : The goods will be shipped exclusively on EX-Works basis through the forwarder chosen by the Customer, or, when requested and agreed, through a courier chosen by our company. BREAKAGES, DAMAGES and MISSING GOODS MUST BE REFUNDED BY THE FORWARDER. Even if the goods are shipped with freight prepaid, the goods always travel at Customer’s risk and peril.

• MANUFACTURE CHANGES : “TITANOX srl” has the right to carry out every kind of manufacture change without obligation to prevent the Customer. All changes brought after the order will not generate any kind of claim.

• CONTESTATIONS AND GOODS RETURN : Will be accepted if made within 3 days from goods reception through registered letter. For every kind of contestation the jurisdiction is the Supplier’s one, even if the order is placed in a different seat. Goods returns will be accepted after previous written authorisation. The supply of any item will not entail any warranty because the conditions of use are out of our direct control.
“ TITANOX srl” WILL NOT ASSUME THE RESPONSIBILITY OF DAMAGES CAUSED TO PERSONS OR GOODS RESULTING FROM THE USE OF ITS PRODUCTS, PRODUCTION MISTAKES AND MATERIAL’S HIDDEN DEFECTS. THE COMPANY WILL SIMPLY REPLACE THE FAULTY PIECES WITHOUT ANY KIND OF DAMAGES REFUND’S OBLIGATION.
Returns without original packaging will not be accepted.

• JURISDICTION : For every kind of contestation the place of jurisdiction is Cremona.
